These Terms of Use (the "Terms") govern access to and use of theMindLogs mobile app and themindlogs.app website (together, the "Service"). Please read them carefully. By downloading, installing or using the Service, you agree to be bound by these Terms.

These Terms govern the relationship between Evergreen and anyone who accesses or uses the Service (the "User" or "you"). Using the Service makes you a User and means you fully and unreservedly accept all the provisions of these Terms in the version published at the time of access.

If you do not agree with these Terms, you must not use the Service.

3. Description of the Service

MindLogs is a mood journal app that lets you record guided entries in several steps (emotion, sensation, context, thought and reaction, among others), see how you evolve through a mood calendar, keep streaks and, in its paid version, get feedback and insights generated with artificial intelligence.

MindLogs is a self-awareness and well-being tool. It is not a medical device, nor a medical, psychological or therapeutic service, and it is not intended to replace them (see section 11).

4. Minimum age

You must be at least 16 years old to use the Service. By accepting these Terms you confirm that you meet this requirement. If you are under 16 you may not sign up for or use the Service. If we detect an account that belongs to someone under that age, we may suspend or delete it.

5. Registration and account

To access the features you need to create an account with an email address or another sign-in method. You agree to:

• Provide truthful, current and complete information.
• Keep your sign-in credentials safe and confidential.
• Notify us of any unauthorized use of your account.

You are responsible for all activity carried out through your account. Each account is personal and non-transferable.

6. Acceptable use

When using the Service you agree not to:

• Use it for unlawful purposes or in breach of these Terms.
• Infringe the rights of third parties or of Evergreen.
• Introduce or spread malicious code, or try to gain unauthorized access to the Service's systems, accounts or data.
• Reverse engineer, decompile or extract the app's source code, except to the extent permitted by law.
• Overload, damage or interfere with the normal operation of the Service or its infrastructure.
• Resell, sublicense or commercially exploit the Service without our express permission.

7. Plans, subscriptions and payments

MindLogs offers a Free plan with basic features and a paidPremium plan by subscription, with extra features such as more daily entries, AI-powered feedback and insights, and personalized challenges.

7.1. Prices and billing periods

Premium subscriptions are offered monthly and yearly. Current prices are shown in the app and in the relevant store before you confirm your purchase, including any applicable taxes. Evergreen may change its prices; changes will not affect subscription periods you have already paid for.

7.2. Billing through the app stores

Subscriptions are purchased and charged through the App Store (Apple) or Google Play (Google), depending on the device you buy from. Charging, renewal, management and cancellation of the subscription are also governed by the terms of the relevant store, in addition to these Terms.

7.3. Automatic renewal

Unless stated otherwise, subscriptions renew automatically at the end of each period (monthly or yearly), and the price in effect at that time is charged to the payment method linked to your Apple or Google account, unless you cancel the renewal before the renewal date.

7.4. Free trial

We may offer a free trial period (for example, 7 days, or 14 days with a referral code). If you do not cancel before the trial ends, it will automatically turn into a paid subscription. You are entitled to only one free trial unless expressly stated otherwise.

7.5. Cancellation and refunds

You can cancel the renewal of your subscription at any time from your account settings in the App Store or Google Play. Cancelling stops future renewals, but you keep Premium access until the end of the period you have already paid for.

Refund requests are handled under the policies of the app store you bought from (Apple or Google). We recommend sending any refund request directly to that store. This is without prejudice to any rights you have under consumer protection law.

8. Referral program

MindLogs may offer a referral program that grants benefits (such as longer trial periods or free months) to both the person who invites and the person invited, subject to the limits and conditions shown in the app. Evergreen may change, suspend or cancel the program, and may withdraw benefits obtained through fraudulent or abusive use.

9. Intellectual property

All rights in the Service, including the software, the design, the "MindLogs" brand, the logos, the texts, the graphics and all other original content, belong to Evergreen or its licensors and are protected by intellectual and industrial property laws.

We grant you a limited, personal, revocable, non-exclusive and non-transferable license to use the Service in accordance with these Terms. No other rights are transferred to you.

10. Your content

You keep ownership of all the content you create in the Service (your journal entries, reflections and any other data you enter, "Your Content").

You grant us only the license needed to host, process and display Your Content in order to provide the Service (including, when you use the artificial intelligence features, processing it to generate feedback and insights). The processing of your personal data is governed by our Privacy Policy.

11. Artificial intelligence features and disclaimer

Some features of the Service use artificial intelligence models to generate comments, suggestions and insights from Your Content. These results:

• Are generated automatically and may contain errors or inaccuracies.
• Are for information and guidance only, for self-awareness and well-being purposes.
• Do not constitute medical, psychological, therapeutic or any other kind of professional advice.

12. Availability of the Service

We try to keep the Service available at all times, but we cannot guarantee it will be free of interruptions, errors or downtime, whether due to maintenance, updates, technical issues or reasons beyond our control. We may modify, suspend or discontinue the Service, or any of its features, in whole or in part.

13. Limitation of liability

To the fullest extent permitted by applicable law, Evergreen will not be liable for indirect, incidental or consequential damages, or for loss of data or profits, arising from the use of or inability to use the Service. The Service is provided "as is" and "as available".

Nothing in these Terms excludes or limits Evergreen's liability where it is not legally possible to do so, including the rights that consumer protection law grants to Users acting as consumers.

14. Data protection

The processing of your personal data is governed by ourPrivacy Policy, which forms an integral part of these Terms. We recommend that you read it to learn what data we process, for what purposes and how to exercise your rights.

15. Changes to the Terms

We may change these Terms to adapt them to legal, technical or Service changes. We will publish the updated version on this page with the date of the last update. When the changes are significant, we will notify you by reasonable means. Continuing to use the Service after the changes take effect means you accept them.

16. Term and termination

These Terms remain in force for as long as you use the Service. You can stop using it and delete your account at any time. We may suspend or cancel your access, in whole or in part, if you breach these Terms or use the Service fraudulently or abusively.

17. Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute will be resolved by the courts that have jurisdiction under the applicable rules. If you are acting as a consumer, the competent courts will be those of your place of residence or those that consumer protection law determines in your favor.
